Terms of Service

This Terms of Service Agreement ("Agreement") is a binding legal contract between you ("Customer") and Serva ("we," "us," or "Company"), a hosting provider registered in Thailand.

By purchasing, accessing, or using any Serva service — including Cloud VPS, Dedicated Servers, or managed services — you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree, you must not use our services.

Serva provides virtual private server (VPS) hosting, dedicated server hosting, managed infrastructure services, and related compute products ("Services"). Services are provided on an unmanaged or partially-managed basis unless explicitly stated otherwise in writing.

We reserve the right to modify, suspend, or discontinue any Service at any time with reasonable notice, except where immediate action is required to protect network integrity or comply with applicable law.

Customer may only use Serva's Services for lawful purposes under Thai law and any other applicable international law. Services may not be used for illegal purposes or in support of illegal activities.

You are solely responsible for ensuring that your use of the Services — and the use of any end user or third party you authorize — complies with all applicable laws, regulations, and this Agreement at all times.

The following are strictly prohibited on all Serva infrastructure:

• Content that violates the Thai monarchy (lèse-majesté) under Section 112 of the Thai Criminal Code
• Any activity violating Thailand's Computer Crimes Act (B.E. 2550 and amendments)
• Hosting or distributing malware, ransomware, botnets, or exploit tools
• Launching or coordinating DDoS/DoS attacks against any target
• Unsolicited bulk email (spam) or phishing operations
• Child sexual abuse material (CSAM) or exploitation of minors in any form
• Unauthorized access to systems, networks, or accounts (hacking)
• Port scanning, vulnerability probing, or network reconnaissance without authorization
• Copyright infringement, piracy, or distribution of unlicensed software
• Operation of proxy or VPN services that facilitate illegal activity
• Cryptocurrency mining without prior written approval from Serva
• Any activity that materially disrupts or degrades Serva's network or other customers' services
• Gambling operations without valid Thai gaming license
• Any other activity prohibited under applicable Thai or international law

This list is illustrative, not exhaustive. Serva reserves the right to determine, in its sole discretion, whether any activity constitutes a violation of this Agreement.

You are solely responsible for all activities that occur on or through your VPS or server, including any activity carried out by:

• You personally
• Any end users you grant access to
• Any third parties using your account credentials
• Any software, scripts, or automated processes you deploy

Serva is not responsible for and has no obligation to monitor, review, or control the content, data, or activities on your server. The infrastructure is yours to manage; the legal compliance is yours to ensure.

You are responsible for maintaining the security of your VPS, including keeping software updated, managing access credentials, and implementing appropriate firewalls. Serva is not liable for security breaches resulting from your failure to maintain adequate security.

Customer agrees to defend, indemnify, and hold harmless Serva, its officers, directors, employees, agents, and affiliates from and against any and all claims, demands, liabilities, obligations, losses, damages, penalties, fines, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• The actual or alleged use of Customer's services in violation of applicable law
• Any violation of this Agreement by Customer or any person using Customer's account
• Any content uploaded, transmitted, stored, or processed on Customer's VPS
• Any claim by a third party that Customer's use of the Services infringes their rights
• Any regulatory fines, penalties, or enforcement actions arising from Customer's activities

This indemnification obligation applies regardless of whether the person responsible was authorized by you to use the services.

To the fullest extent permitted by applicable law:

• Serva's maximum aggregate liability under any theory of law (including breach of contract, tort, or strict liability) shall not exceed the total fees paid by Customer for the three (3) months immediately preceding the event giving rise to liability.
• Serva shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, loss of data, business interruption, or reputational harm — even if Serva has been advised of the possibility of such damages.
• Services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, or non-infringement.

Serva provides infrastructure services and is under no obligation to monitor, review, or police the content, data, traffic, or activities on your VPS or server.

However, Serva reserves the right — but not the obligation — to investigate, remove, or restrict access to any content or account when Serva becomes aware of a potential violation of this Agreement, applicable law, or where continued operation may expose Serva to civil or criminal liability.

Serva is not an editor or publisher of Customer content and does not exercise editorial control over it.

Serva may suspend or terminate service immediately and without prior notice if:

• Serva reasonably believes the services are being used in violation of this Agreement or applicable law
• Customer fails to cooperate with any reasonable investigation of suspected violations
• Suspension is necessary to protect Serva's network, infrastructure, or other customers
• Required or requested by law enforcement, a regulatory agency, or a court order
• Customer's account is overdue on payment beyond the grace period

No refunds will be issued for accounts terminated due to violation of this Agreement or applicable law. Serva will endeavour to provide notice before suspension where it is safe and legally permissible to do so.

Customer agrees that Serva may, without prior notice to Customer:

• Report to appropriate authorities any conduct that Serva reasonably believes violates applicable law
• Provide information about Customer, their account, assigned IP addresses, account history, and usage data in response to formal or informal requests from law enforcement, regulatory agencies, or courts
• Preserve and disclose account data as required by applicable law, including Thailand's Computer Crimes Act (พ.ร.บ. คอมพิวเตอร์)

Serva will comply with all valid orders and requests from Thai law enforcement authorities, including the Department of Special Investigation (DSI) and the Technology Crime Suppression Division (TCSD).

All fees are quoted and billed in Thai Baht (THB) and exclude VAT unless stated otherwise. Services are pre-paid for the selected billing cycle.

Accounts not settled within the grace period will be suspended. Serva reserves the right to permanently delete VPS data from suspended accounts after 7 days of non-payment without further notice.

Refunds are only issued at Serva's discretion. No refunds will be provided for: accounts terminated for policy violations, any month already billed, or services consumed prior to cancellation.

Serva reserves the right to change pricing at any time. Existing customers will receive at least 30 days' notice before price changes take effect on their renewal.

This Agreement is governed by and construed in accordance with the laws of the Kingdom of Thailand. Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Thailand.

If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

Serva may update this Agreement at any time. Continued use of Services after the effective date of any revision constitutes acceptance of the revised terms. The current version is always available at serva.services/tos.
